Texas King Frenchies Terms & Conditions and Liability Waiver

Effective Date: October 2025

This Agreement (“Agreement”) is entered into between Texas king frenchies, a Texas business (“Company,” “we,” “our,” or “us”), and the undersigned client (“Client” or “Owner”), concerning the care and housing of the Client’s mother dog(s) (“dams”) and their puppies.

By engaging Texas king frenchies services, the Client acknowledges and agrees to the following:

1. Services Provided​

Texas king frenchies provides professional care, housing, and optional extended assistance for dams and their litters for an agreed-upon period. The specific scope of services, care duration, and fees will be defined in a separate Service Agreement or invoice.

2. Acknowledgment of Risks ​

The Client understands and accepts that:

​

• Pregnancy, whelping, and postnatal care involve inherent risks, including injury, illness, and death of the dam or any puppy.

• Puppies are particularly prone to congenital defects, disease, and accidental death, even under careful supervision.

• Despite the Company’s reasonable care, these risks cannot be fully eliminated.​

The Client voluntarily assumes all risks associated with the care and custody of their animals while under the Company’s supervision.

3. Release of Liability​

To the fullest extent permitted by Texas law, the Client hereby releases, waives, and forever discharges Snuggles Maison, its owners, officers, employees, contractors, agents, affiliates, insurers, and stakeholders (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities of any kind, known or unknown, arising from or related to:

• Injury, illness, or death of any dam or puppy while in the Company’s care, whether occurring on or off Company premises;

• Any act, error, or omission (including ordinary negligence) by the Company or its representatives; or

• Transport or handling of the animals by or on behalf of the Company.

This waiver does not release liability for conduct that constitutes gross negligence, willful misconduct, or intentional harm, as prohibited under Texas law.

The Client acknowledges this waiver is intended to be as broad and inclusive as permitted under Texas Civil Practice & Remedies Code § 93.001 et seq.

4. Veterinary Care and Emergencies​

The Client authorizes Snuggles Maison to obtain veterinary care, at its discretion, if any animal requires medical attention. The Client agrees to reimburse all reasonable veterinary and transportation expenses incurred.
 

The Company will make reasonable efforts to notify the Client promptly of any such event.

5. Health Disclosure​

The Client affirms that, to the best of their knowledge, all animals entrusted to Snuggles Maison are healthy and free of contagious conditions, and that all known medical or behavioral issues have been disclosed in writing.

Failure to provide accurate health information may release the Company from any obligation under this Agreement.

6. Indemnification​

The Client agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, damages, costs, or expenses (including reasonable attorney’s fees) arising out of:

​

• The health or behavior of the animals prior to or during care;

• Damage or injury caused by the animals to other persons, animals, or property; or

• The Client’s breach of this Agreement.

7. No Guarantees

Texas king frenchies makes no guarantee or warranty, express or implied, as to the survival, health, or condition of any dam or puppy, or the success of any care or procedure performed.

8. Termination of Services​

Either party may terminate services with reasonable notice. Fees for all services rendered prior to termination remain due and payable.

9. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising under this Agreement shall be brought exclusively in a court of competent jurisdiction located in the county where Texas king frenchies operates, and both parties consent to such venue and jurisdiction.

10. Entire Agreement and Amendments

This document constitutes the entire understanding between the parties and supersedes all prior oral or written agreements regarding the same subject matter.
 

No amendment or modification shall be valid unless in writing and signed by both parties.

11. Severability

If any provision of this Agreement is found invalid under Texas law, the remaining provisions shall remain in full force and effect.

BY ACKNOWLEDGING BELOW, the Client acknowledges that they have read, understood, and voluntarily agreed to the terms herein, and that they are signing this Agreement freely and voluntarily, intending to be legally bound.
